Mexicana Airlines filed a lawsuit against travel agent FS SunTours Inc.
and Valley National Bank in a dispute over $280,000 that the bank
allegedly holds in an escrow account set up by Mexicana in 2001. The
airline announced SunTours sold tickets for Mexicana flights and owes
the air carrier the money under charter and bulk-seat sales agreements
in effect in 2004 and 2005. The complaint filed Monday at the federal
courthouse in Newark, Valley's global escrow department has refused to
hand over the cash without SunTours' consent, and SunTours has refused
to sign a release. With conflicting claims, Valley is justified in
requiring either a release from SunTours or a court order before
letting the money go. Valley did not immediately respond to a request
for comment and SunTours, a specialist in Mexico and Hawaii vacation
tours, could not be reached. SunTours was sold by former parent One
Travel Holdings Inc. in 2006 after its fortunes took a turn for the
worse amid increased competition from discount airlines. Travel agents
sued the company for non-payment of more than $1 million in commissions
and customers complained of not receiving refunds on trips that
SunTours canceled.
